Where your Briarwood case will be heard

Most Queens personal injury cases are filed and heard at the Queens County Supreme Court, Civil Term, at 88-11 Sutphin Boulevard in Jamaica. If your case goes to litigation rather than settling, that is the building you will be walking into.

Briarwood is closer to that courthouse than almost any neighbourhood in the borough — straight down Hillside Avenue or the Van Wyck service road. Our office is a few minutes further on. Motion appearances, depositions, compliance conferences and filings all happen locally, which keeps the case moving and keeps your travel down.

Worth knowing: the large courthouse you can see on Queens Boulevard in Kew Gardens handles criminal matters, not civil ones. Personal injury cases go to Sutphin Boulevard.

Why Briarwood sees the accidents it does

Briarwood is a quiet, low-rise neighbourhood with a hostile perimeter. Its interior streets are residential and calm. Its edges are Queens Boulevard, the Van Wyck Expressway, the Grand Central Parkway, Union Turnpike and Hillside Avenue — and that is where the injuries happen.

At the neighbourhood’s northwest corner sits the Kew Gardens Interchange, where the Van Wyck, the Grand Central Parkway, the Jackie Robinson Parkway and Union Turnpike meet. It is an incomplete junction: several movements between those highways cannot be made directly, so drivers finish the connection on local roads instead. Highway-speed traffic ends up on Union Turnpike and Queens Boulevard, which are also the streets people walk across.

The city’s own figures for Queens Boulevard between Union Turnpike and Hillside Avenue — the stretch running along Briarwood — record 233 people injured between 2016 and 2020, with five of the six severe injuries being pedestrians. A pedestrian was killed in 2021 at Queens Boulevard and 84th Drive, which is the intersection at the Briarwood subway entrance. The corridor sits at 4.1 pedestrians killed or severely injured per mile.

The pattern the Department of Transportation identified there is worth repeating, because it is the opposite of what insurers argue: most pedestrians hurt on that stretch were crossing in the crosswalk, with the signal, and were hit by a driver who failed to yield. Left turns are the most common crash type.

Hillside Avenue, along the southern boundary, is a Vision Zero priority corridor in its own right. On the 1.4 miles from Sutphin Boulevard to 179th Place, the city recorded three fatalities, 35 crashes involving death or severe injury, and 568 injury crashes in total. Parsons Boulevard — Briarwood’s eastern edge — is one of the named priority intersections.

The cases we see most often from this part of Queens:

  • Pedestrian collisions on Queens Boulevard, particularly at the 84th Drive and 87th Avenue crossings by the subway
  • Left-turn crashes, the dominant crash type on this stretch
  • Rear-end and sideswipe collisions on the Van Wyck service roads and at the Kew Gardens Interchange approaches
  • Crashes involving drivers using local streets to complete a highway movement the interchange does not allow
  • Slip and fall injuries around the apartment buildings on Hoover Avenue, Main Street and Parsons Boulevard
  • Falls on the Briarwood station stairs, where an MTA claim carries a strict 90-day notice deadline

One practical note about that station. It was called Van Wyck Boulevard until 1998, then Briarwood–Van Wyck Boulevard until 2015, and only then Briarwood. Older police reports, ambulance records and medical notes may use any of the three. They are the same place, and if a record says something different from what you remember, that is usually why.

The claims we handle in Briarwood

Most of what comes through the door from this neighbourhood falls into a handful of categories.

  • Car accidents on Queens Boulevard, Hillside Avenue, Parsons Boulevard and the Van Wyck service roads
  • Pedestrian and cyclist collisions, especially crossing Queens Boulevard, where the crossing distances are long and the turning conflicts concentrated
  • Slip and fall and premises claims in apartment buildings and on the commercial frontages
  • Construction accidents, which in New York carry protections most workers do not know they have — including ones that apply regardless of immigration status or whether you were paid off the books
  • Truck and commercial vehicle crashes — note that the Grand Central Parkway bars commercial vehicles entirely, which can itself be a fact in the case
  • E-bike and e-scooter collisions
  • Bus injuries and subway claims, both subject to the 90-day MTA notice
  • Hit and run, and crashes where the other driver had no insurance

Sidewalk falls in Briarwood cut two ways

Since 2003, New York City has placed responsibility for most sidewalks on the owner of the building beside them — except for owner-occupied one-, two- and three-family homes used purely as residences. For those, the City remains responsible, and a claim against the City carries a 90-day notice of claim deadline rather than three years.

Briarwood contains both kinds of property, sometimes on the same walk. The residential side streets — much of which the city deliberately downzoned in 2008 to protect their low-rise character — are full of detached and semi-detached one- and two-family houses where the exemption may well apply. But the frontages on Queens Boulevard, Hillside Avenue, Main Street and Parsons Boulevard, the apartment buildings near Hoover Avenue, and Parkway Village — a co-operative of roughly 675 units — are none of them one- to three-family homes. On those, the owner answers for the sidewalk and you have three years.

Three traps worth naming. A three-family house that nobody who owns it lives in is not exempt. A one- to three-family house with any commercial use is not exempt, because the law requires the property be used exclusively as a residence. And a co-op is not a one- to three-family home, whatever it looks like from outside.

Where you were treated matters

The two hospitals nearest Briarwood fall on opposite sides of a line that decides your deadline.

Jamaica Hospital Medical Center sits directly on the Van Wyck service road, the same highway that forms Briarwood’s western edge. It is a private not-for-profit and it is the area’s Level I trauma centre, so serious crash injuries from this neighbourhood usually go there. A claim against it follows ordinary rules.

NYC Health + Hospitals/Queens on 164th Street — still widely called Queens Hospital Center — is a city hospital. A claim arising from care there carries the 90-day notice requirement, and the notice has to be served on the right entity.

The names are similar and both are in Jamaica. If you were treated after your accident, bring the paperwork to your first appointment. Which building you were taken to can change the deadline by more than two and a half years.

What to do after an accident in Briarwood

Get medical attention the same day, even if you feel fine. A gap between the accident and the first treatment is the first thing an insurer uses against you.

Call 911 and get a police report. Briarwood is covered by the 107th Precinct on Parsons Boulevard. If the police do not attend, file a report yourself.

Photograph the scene before anything is moved — the vehicles, the road, the hazard, your injuries. If you were hit crossing Queens Boulevard, photograph the signal and the crosswalk markings as well. Whether you were crossing with the signal is the single fact most likely to be disputed.

Take names and numbers from witnesses. Queens Boulevard is busy and there are usually several; they disappear within minutes.

Do not give a recorded statement to the other side’s insurer. You are not obliged to, and it is rarely used to help you.

Watch the deadlines. Three years from the date of the accident for most personal injury claims in New York. Ninety days for a notice of claim if the City, the MTA or a public hospital is involved.

Briarwood injury claims — common questions

Where will my case be heard?

Queens County Supreme Court, Civil Term, at 88-11 Sutphin Boulevard in Jamaica. Not the courthouse on Queens Boulevard — that one handles criminal matters.

How long do I have to bring a claim?

Generally three years from the date of the accident in New York, and two and a half years for medical malpractice. If a city agency, the MTA or a public hospital is involved, a notice of claim has to be filed within 90 days. Call early rather than waiting to see how you heal.

I was crossing with the light and still got hit. Does that help my case?

Yes, and it is more common than people assume. The city’s own analysis of this stretch of Queens Boulevard found that most pedestrian injuries happened to people crossing in the crosswalk with the signal, struck by a driver failing to yield. If that is what happened to you, say so early and photograph the crossing.

My accident report says Van Wyck Boulevard station. Is that a mistake?

No. That is the old name for Briarwood station, used until 1998, with Briarwood–Van Wyck Boulevard in between until 2015. Records still turn up with all three.

What does it cost to start?

Nothing. We work on contingency, which means we take a percentage only if we win. If we recover nothing for you, you owe us nothing.

Do I have to come to the office?

No. We can take the details over the phone or on WhatsApp, and if your injuries make travel difficult we will come to you. But we are close — 109-12 Jamaica Avenue, a few minutes across the Van Wyck.

A Track Record Of Success

It’s Time To Win Your Case, Big.

Michael D. Ribowsky and his accident lawyers handle claims for physical and psychological injuries caused by someone else’s negligence. A great deal turns on timing and on detail — what was photographed, when treatment started, who was spoken to and when. Those are the things that decide what a case is worth, and they are decided in the first days rather than at the end.

We take every case seriously and we do what it takes to recover the most the facts will support, which depends on where and how you were injured and what it has cost you. Briarwood is one of many neighbourhoods we cover. See accident attorneys covering Queens and how we work across the whole borough.

What does a personal injury lawyer do?

The pain and suffering a person can endure from a car accident can last a lifetime. Severe injuries, employment lost because of paralysis, and other heavy expenses will likely become a way of life for these victims.

Most injury victims in the Big Apple consider getting their costs covered by their auto insurance company but sometimes, the insurance companies fall short of providing you the compensation which you truly deserve. Sometimes, your insurance company will settle with you and provide you with your additional funds. Other times, you will not receive the payout you are looking for because the other side is fighting back to impose their expenses on you. You can believe the insurance company or responsible party will have legal representation.

This is usually the point where you will seek the help of a qualified law firm Ribowsky Law to either help you settle directly with the other party involved in the accident or injury and if they refuse we can head to the courtroom to face them.

So what are you waiting for? Don’t short-change yourself and retain the firm that will provide you with the integrity and the financial results you have been searching for.

If your accident happened further south, closer to the airport, we also handle South Ozone Park injury claims.
